Canada Permanent Residence Through Family Sponsorship: Spousal/Common Law Sponsorship

One of the most common Canada Permanent Residence pathways is going through marriage or common law. Canadian citizens or permanent residents in Canada can sponsor their spouses and their children to Canada as permanent residents.

Before You Can Sponsor Your Spouse In Canada, Here Are The Eligibility Criteria That You Need To Meet First. You Must Be:

  • At least 18 years old.
  • A citizen or permanent resident of Canada or a registered Indian in the Canadian Indian Act.
  • Not be in receipt of social assistance from the government other than due to disability.
  • Financially capable of supporting and providing for yourself, your spouse, and your spouse’s dependent children’s basic needs if applicable. But there is no minimum income requirement.

On The Other Hand, Your Spouse Must Be:

  • Married legally to you.
  • At least 18 years old.

For Common-Law Sponsorship, there are a few differences:

  • The person must have cohabitated for at least 12 months before the applicant can be sponsored.
  • The person needs a “Statutory Declaration of Common-Law Union”
  • At least 18 years old

BC PNP Entrepreneur Immigration (EI)

BC PNP Entrepreneur Immigration (EI) is for experienced entrepreneurs who are ready to invest in and actively manage a business in B.C.
The BC PNP Entrepreneur Immigration category allows foreign nationals to invest and run a business in the province of British Columbia, while pursuing a path towards permanent residency for them and their family. It is a points-based program where applicants are accepted into the program depending on their business experience, investment capacity, business plan language ability among other factors. 

Steps towards Provincial Nomination:

  1. The applicant or group of applicants must submit a business plan 
  2. The plan will be evaluated by the BC PNP program officials who will approve or reject the business plan.
  3. Once approved, the applicants will sign a performance agreement and will be issued a work permit to invest and work on the business over the course of 14 – 20 months.
  4. The BC PNP Officials will evaluate whether the applicant(s) have met the objectives of the performance bond and will nominate the applicant(s) for PR if approved. 
  5. The applicant(s) can them apply for PR on the basis of this provincial nomination.

BC PNP Entrepreneur Immigration Overview

British Columbia offers immigration pathways for experienced entrepreneurs who want to start or grow a business in B.C. and eventually become permanent residents of Canada.

The salient points of two of the prominent streams for BN PNP Immigration are elaborated below:

For entrepreneurs who want to start a business in any part of B.C.

Minimum Requirements:

  • Net worth of at least $600,000 CAD
  • Invest at least $200,000 CAD in a new or existing business
  • Ownership – At least 33.33 %
  • Create 1 full-time job for a Canadian or PR
  • Business and/or management experience (or 2-year diploma)
  • 50 km radius and 75% time physically present
  • Partner with BC PNP co-registrant allowed. 
  • English or French at CLB 4
  • Legal immigration status in Canada or current country

Process:

  1. Prepare and register a business proposal (fee: $300)
  2. Registration scores – Total 200 points (120 points for self-declared section; 80 points for business concept). Must score minimum of 40 points in business concept section. Total score must be at least 115 points to qualify.
  3. Net worth verification before invited to apply
  4. Registrations are scored within six weeks
  5. If invited, apply and submit documents (fee: $3,500)
  6. Get a work permit and start your business
  7. After 18–20 months, submit a report showing you’ve met your targets
  8. Minimum amount of time to submit a final report – 18 months after work permit
  9. Get nominated for permanent residence

For entrepreneurs starting a new business in smaller B.C. communities (outside major cities)

Minimum Requirements:

  • Net worth of at least $300,000 CAD
  • Invest at least $100,000 CAD
  • Ownership – At least 51 %
  • Create 1 full-time job
  • Must be referred by a participating community
  • Partner with BC PNP co-registrant not allowed. Must do alone.
  • 50 km radius and 75% time physically present
  • Visit the community for an exploratory trip
  • English or French at CLB 4

Note: Only new businesses are allowed. Applicants must align their business proposal with the community’s priorities.

Process:

  1. Prepare and register a business proposal (Govt. fee: $300)
  2. Registration scores – Total 200 points (140 points for self-declared section; 60 points for business concept). No minimum business concept score. Total score must be at least 105 points to qualify.
  3. Net worth verification before invited to apply
  4. Registrations are scored within four weeks
  5. If invited, apply and submit documents (Govt. fee: $3,500)
  6. Get a work permit and start your business
  7. After 12–15 months, submit a report showing you’ve met your targets
  8. Minimum amount of time to submit a final report – 12 months after work permit
  9. Get nominated for permanent residence
